1. Acceptance of Terms

By using or visiting the Burnaby Pickleball Association website (the "Website"), you agree to these terms and conditions (the "Terms"). We may, in our sole discretion, revise these Terms at any time without advance notice to you. You are bound by such revisions by continuing to use or visit the Website after they are posted online.

2. BPA Website

These Terms apply to all users of the Website, including users who contribute content to the Website. The Website may contain interactive areas designed to allow you to post content on the Website and/or comment. The use of these features is additionally governed by the Code of Conduct.

The Website may contain links to third party websites that are not owned or controlled by the BPA. The links are provided for your convenience, and their inclusion does not imply approval or endorsement of the third party websites by us. We have no control over, and assume no responsibility for the content, privacy policies, or practices of any third party websites.

3. User Accounts

To access some features of the Website, you may have to register for a user account. When registering, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your user account, and you must keep your account password secure. You must notify us immediately of any breach of security or unauthorized use of your user account.

Although the BPA will not be liable for your losses caused by any unauthorized use of your user account, you may be liable for the losses of the BPA or others due to such unauthorized use.

4. Ownership of Website Content

As between you and the BPA, the BPA owns all intellectual property rights in all materials on or comprising the Website ("Content"), excluding User Content. The BPA grants you a limited license to use, download, print, or reproduce Content, subject to these conditions:

  • it must be used or reproduced accurately, without any modification;
  • it must identify the BPA as the source;
  • it must be used solely for non-commercial purposes.

The BPA's express, prior, written permission is required for any other use. The BPA logos are trade-marks of the BPA and may not be used without our express written permission.

5. User Content; Privacy

You are solely responsible for your own User Content and the consequences of posting or publishing it. By uploading or posting User Content to the Website, you automatically grant the BPA a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, translate, and publish such User Content. You represent and warrant that you own or have the rights to the User Content you post.

By accessing and/or using the Website, you may provide us with personal information as described in our Privacy Policy.

6. Disclaimer

Your use of this website is at your own risk. The website and content are provided "as is" and without warranties or conditions of any kind, either expressed or implied. We do not warrant that the website will be uninterrupted or error-free, that defects will be corrected, or that this website or its server are free of viruses or other harmful components.

7. Limitation of Liability

The BPA, its employees, agents, officers and directors will not be liable for any direct, indirect, incidental, punitive, consequential, special, exemplary, or other damages, regardless of the legal theory, even if advised of the possibility of such damages, to the fullest extent permitted by law.

8. Indemnity

You agree to defend, indemnify and hold harmless the BPA, its employees, agents, officers and directors from any claims, damages, obligations, losses, liabilities, costs and expenses arising from: (i) your use of and access to the website; (ii) your violation of any third party right; or (iii) any claim related to your User Content. This obligation survives these Terms and your use of the website.

9. Miscellaneous

You affirm that you are either more than 18 years of age or possess parental or guardian consent to agree to these Terms. These Terms are governed by the laws of the Province of British Columbia, Canada, and you agree to submit to the exclusive jurisdiction of its courts. You may not assign these Terms without our prior written consent. These Terms constitute the entire agreement between you and the BPA regarding this subject matter.

10. Code of Conduct

You may not use the BPA Website for any illegal or unauthorized purpose, nor in any manner that could disable, overburden, damage, or impair the Website. When using the Website, you agree that you will not:

  • post or upload any inappropriate, promotional, defamatory, destructive, obscene, or unlawful content;
  • defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others;
  • post User Content that infringes any intellectual property right of any party;
  • impersonate another person or falsify attributions or notices;
  • use the Website for surveys, contests, junk email, or spamming;
  • use any robot, spider, or scraper to index the Website or collect information about other users;
  • upload files containing viruses or other harmful software;
  • falsely imply that User Content is sponsored or endorsed by any party.

The BPA reserves the right to monitor use of this Website, remove any User Content, and/or terminate your account without notice for breach or any other reason.
